HIPPA The Health Insurance Portability and Accountability Act of 1996 (HIPAA) provides rights and protections for participants and beneficiaries in group health plans. Employers with one or more employees must comply with the dictates of HIPAA. The Act includes protections for coverage under group health plans that limit exclusions for preexisting conditions, prohibits discrimination against employees and dependents based upon their health status and provides an opportunity to enroll in a new plan for individuals in certain circumstances. HIPAA may also afford a person the ability to purchase individual coverage if you have no group health plan coverage available, and they have exhausted COBRA or other continuation coverage.
The Department of Labor enforces the health care portability requirements on group health plans under HIPPA. Additionally, participants and beneficiaries may enforce their rights under ERISA, as amended by HIPAA via a civil action.
