USERRA (Uniform Services Employment and Reemployment Rights Act of 1994) The Act seeks to ensure that members of the uniformed services are entitled to return to their civilian employment upon completion of service, protecting their right to be reinstated with the seniority, status, and rate of pay they would have obtained had they remained continuously employed by their civilian employer. During the employee's service in the military, USERRA allows for the employee's continuation of health insurance coverage for his or her family for a certain period of time. The law also protects individuals from discrimination in hiring, promotion, and retention on the basis of present and future membership in the armed services. USERRA is applicable to all public and private employers in the United States regardless of size.
Penalties for non-compliance may include back pay, benefits and even liquidated damages if employer conduct was willful.
